Iraq’s Federal Court establishment is unconstitutional: Kurdistan Judicial Council

The Kurdistan Region Judicial Council said on Wednesday that the Iraqi Federal Supreme Court has overstepped its legal authority despite its establishment contrary to Article 92 of the Constitution and Federal Court Law No. 30 of 2005.

The council said in a statement that the Kurdistan Region has the right to exercise its constitutional rights within the framework of the Iraqi state

It added that elections fall within the jurisdiction of the Kurdistan Parliament and are unrelated to the Federal Court. 

On February 21, the Federal Court issued a ruling stating that the Kurdistan Region’s parliament should consist of 100 lawmakers instead of the previously planned 111.  The court also decreed that the upcoming parliamentary elections in the Kurdistan Region should be supervised by the Iraqi Electoral Commission.
